What is a toll-road violation?
Sometimes customers forget to carry the correct
amount of change needed to pay tolls or do not properly anticipate
the amount of the toll. To meet our obligation to collect
tolls for every vehicle that uses The Toll Roads, a violation
enforcement process is in place.
If you pass through a tolled location without
making the proper payment, pictures of your vehicle are taken.
These pictures are reviewed and the plate information is sent
to the Department of Motor Vehicles (DMV). The DMV provides
the name and address of the registered owner. The registered
owner will receive a violation notice in the mail (usually
within two weeks).
Each violation transaction is assessed a $47.50
processing fee in addition to the toll amount due. If you
do not have previous violations, the violation notice will
include an offer to open a FasTrak account. FasTrak is a convenient
way to pay your tolls electronically. When opening a FasTrak
account, you establish a prepaid account from which tolls
can be deducted. We will apply $15 of the violation processing
fee to your prepaid balance if you choose to open an account.
If you prefer not to open an account, you can simply mail
in the $47.50 processing fee and the toll amount upon receipt
of the violation notice.
If you fail to respond as outlined in the violation
notice, an additional $47.50 fine may be assessed and a hold
may be placed on your vehicle registration.
If your car is not registered to your current
address or you were driving a car that is not registered to
you, the violation notices will be mailed to the address the
DMV has on file. If you wish to redirect the violation notices
to your current address, please call the Violations Department
within 5 to 7 days of the violation. At this time, we should
be able to locate the violation and assist you in resolving
it.
If you have questions, please call our Violations
and Collection Department at (949) 727-4800.

What is the fine for a toll-road
violation?
Each violation is assessed a $47.50
processing fee on top of the toll amount due. For example,
if you did not pay the required toll to pass through the Windy
Ridge mainline plaza on the 241 Toll Road, you would be required
to pay a $47.50 processing fee plus the $2.50 toll for a total
of $50.
If you fail to respond to the
first notice, a second violation notice will be mailed to
you with an additional $40 fine. Failure to respond to the
second notice could result in a hold on your vehicle registration.

How can I resolve a violation?
You will receive a "Notice of Toll Evasion" in the mail usually
within two weeks from the time the violation occurred. Simply
follow the instructions for payment and mail the amount due
with the bottom portion of the notice to the address indicated.

How can I dispute a violation?
You can dispute a violation online
or by filling out the "Contest of Notice" portion of your
"Notice of Toll Evasion." This notice is typically mailed
to you within two weeks of the violation. Please include a
written explanation for contesting the violation. We will
investigate the circumstances and provide the results by mail.
If you are not satisfied with the
results of the initial investigation, you can request an administrative
review within 15 days of the postmark date of the results
of the initial investigation. If you are not satisfied with
the results of the second review, then you can file an appeal
with the municipal court. The procedures for administrative
review and appeal are set forth in California Vehicle Code,
Section 40255 and 40256.

I used The Toll Roads and
didn't pay the correct toll. Will I receive a violation?
If so, what is the process? If
you pass through a toll location without paying, pictures
of your vehicle are taken. These pictures are reviewed and
the information is sent to the Department of Motor Vehicles
(DMV). The DMV provides the name and address of the registered
owner. The registered owner will receive a violation notice
in the mail usually within two weeks.
Each violation transaction is assessed
a $47.50 processing fee in addition to the toll amount due. For example,
if you did not pay the required toll to pass through the Catalina
View mainline plaza on the 73 Toll Road, you would be required
to pay $52.50 -- a $47.50 penalty plus the $5.00 toll.
If you do not have previous
violations, the violation notice will include an offer
to open a FasTrak
account. FasTrak is a convenient way to pay your tolls
electronically. You can open a prepaid FasTrak account with
a credit card, check or cash, and tolls will be deducted automatically
when you pass through the designated FasTrak lanes. We will
apply $15 of the violation-processing fee to your prepaid
balance if you choose to open an account. If you prefer not
to open an account, you can resolve the violation by simply
mailing in the amount due upon receipt of the violation notice or click here to pay your violation securely on line.
If you fail to respond as outlined
in the violation notice, an additional $47.50 penalty may be
assessed and a hold may be placed on your vehicle registration.
If your car is not registered to your current address or you
were driving a car that is not registered to you, the violation
notices will be mailed to the address the DMV has on file.
The notice will be sent to the registered owner of the vehicle.
If you would like to pay the violation, you can call our violations
staff at (949) 727-4800 after 7 days, but the letter will
be sent to the registered owner.

I am a 91 FasTrak customer
and I received a violation notice from TCA/The Toll Roads.
What do I do?
You most likely received a violation
because your transponder failed to read and your license plate
is not on file with the 91 Express Lanes. To resolve the violation,
you should:
- Contact the 91
Express Lanes to check and update your vehicle information
and check the status of your account. Visit their website
or call (800) 600-9191.
- Obtain a "Certification of Account" for the dates of
the violation. This certification essentially states that
your account was in good standing with the 91 Express Lanes
on the date the violation(s) occurred.
- Mail the certification and a check for the toll amount
due to "The Toll Roads" in the envelope provided with the
violation notice.
To prevent future violations:
- Make sure your account with the 91
Express Lanes is updated with new vehicle license plates.
Visit their website
or call (800) 600-9191.
- Make sure your transponder is properly
mounted to your windshield for proper reading. The CHP
is authorized to cite drivers who fail to properly mount
their transponders to the windshield. While the 91 Express
Lanes and The Toll Roads both use FasTrak for electronic
toll collection, each tollway is operated by different agencies.
The
91 Express Lanes are operated by the OCTA.
The Toll Roads are operated by the Transportation
Corridor Agencies (TCA), a public government agency.

How can TCA put a hold on
my DMV vehicle registration?
TCA has an agreement with the DMV to receive license plate
information and authorize vehicle registration holds. The
TCAs' authority stems from 1996 state laws (the Streets and
Highways Code and California Vehicle Code).
